These Terms of Service ("Terms") govern your use of Free for All eCards (the "Service") operated by us ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

PLEASE READ THIS SECTION CAREFULLY. BY USING THIS FREE SERVICE, YOU ACKNOWLEDGE AND AGREE TO THE FOLLOWING:

• • Your data and cards may disappear at any time without notice or recourse
• • We have NO LIABILITY for data loss, service interruptions, or any damages whatsoever
• • You are SOLELY RESPONSIBLE for backing up any important content
• • We may discontinue the Service at any time without notice
• • This is NOT a commercial service with service level agreements (SLAs) or guaranteed uptime
• • You should not rely on this Service for mission-critical or irreplaceable content
• • By using this Service, you accept ALL RISKS associated with data loss and service availability

If you need guaranteed availability, data retention, or support, you should use a paid commercial service instead. This free Service is provided for convenience only, without any obligations on our part.

Our Service

Free for All eCards allows users to create, share, and collaborate on digital greeting cards. Our Service includes:

• • Creating and customizing digital greeting cards
• • Inviting others to contribute messages, photos, and media
• • Sharing completed cards with recipients
• • Managing and organizing your created cards (with account)

User Accounts

While you can use basic features without an account, creating an account provides additional benefits. By creating an account, you acknowledge and agree to the following:

• • You are solely responsible for maintaining the security of your account credentials (username, password, etc.)
• • You are fully responsible for all activities that occur under your account, whether authorized by you or not
• • We are not liable for any loss or damage arising from your failure to maintain account security
• • We are not responsible for unauthorized access resulting from stolen, shared, or compromised credentials
• • You must use a strong, unique password and keep it confidential
• • You must provide accurate and complete information when creating an account
• • You must promptly update any information that becomes inaccurate
• • You must be at least 13 years old to create an account
• • We may terminate or suspend accounts at our sole discretion without notice or liability

Acceptable Use

You may use our Service for lawful purposes only. You agree not to use the Service:

Service Availability and Discontinuation

THE SERVICE IS PROVIDED ON AN "AS AVAILABLE" BASIS. WE MAKE NO GUARANTEES REGARDING SERVICE AVAILABILITY, UPTIME, OR ACCESSIBILITY.

• • The Service may be unavailable at any time for any reason, including but not limited to maintenance, technical issues, or business decisions
• • We may discontinue the Service permanently at any time, with or without notice
• • We are under no obligation to provide advance notice of service interruptions or discontinuation
• • We are not responsible for any consequences resulting from service unavailability or discontinuation
• • You should not rely on the continued availability of the Service for any purpose

Data Loss and Deletion

WE PROVIDE NO GUARANTEES REGARDING DATA RETENTION, AVAILABILITY, OR RECOVERY. BY USING THIS SERVICE, YOU ACKNOWLEDGE AND ACCEPT THE FOLLOWING:

• • Your cards, content, and data may be deleted at any time without notice or reason
• • We are not responsible for backing up your content or data
• • We have no obligation to retain, store, or provide access to any content or data
• • Data loss may occur due to technical failures, security incidents, business decisions, or any other reason
• • We are not liable for any data loss, corruption, or unavailability regardless of cause
• • You are solely responsible for maintaining your own backups of any important content
• • We may delete inactive accounts and associated data at our discretion
• • Once deleted, data cannot be recovered

Account Security and Passwords

YOU ARE SOLELY RESPONSIBLE FOR THE SECURITY OF YOUR ACCOUNT, USERNAME, AND PASSWORD.

• • You must maintain the confidentiality of your login credentials
• • You are fully responsible for all activities under your account, whether authorized or not
• • We are not liable for any unauthorized access to your account
• • We are not responsible for password resets, account recovery, or access issues
• • If you lose access to your account, we may be unable or unwilling to restore access
• • We are not liable for any consequences of compromised accounts or stolen credentials
• • You must immediately notify us of any suspected unauthorized access

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO:

• • Loss of profits, revenue, data, use, goodwill, or other intangible losses
• • Damages resulting from unauthorized access to or alteration of your content

• • Damages resulting from your reliance on the Service
• • Damages resulting from viruses, malware, or other harmful code
• • Damages resulting from user content or third-party actions
• • Any other damages arising from your use of or inability to use the Service

IN ANY EVENT, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (WHICH IS $0 FOR A FREE SERVICE).

THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

Termination

Either party may terminate this agreement at any time:

• • You can delete your account and data at any time
• • We may suspend or terminate accounts that violate these Terms
• • We may discontinue the Service with reasonable notice
• • Upon termination, your right to use the Service ceases immediately

Content Removal

We reserve the right to remove any content that violates these Terms or applicable laws. We'll make reasonable efforts to notify you before removing content, but we may remove content immediately if it poses a safety risk or legal liability.

Dispute Resolution

We encourage resolving disputes through direct communication. If you have a concern, please contact us at hello@groupecard.com. For legal disputes that cannot be resolved informally, both parties agree to resolve disputes through binding arbitration rather than court proceedings, except for small claims court matters.

Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Changes to Terms

We may modify these Terms from time to time. When we do, we'll post the updated Terms on this page and update the "last updated" date. If changes are significant, we'll notify users via email (if you have an account) or through the Service. Your continued use after changes become effective means you accept the new Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
